Explanation anyone?
Hi!
I am writing this in the hope someone can give me a satisfactory explanation/comment to the following issue.
Week after week I see on eBay some dealers (mainly from Germany) selling bootlegs of otherwise commercially unavailable scores.
Isn't it against eBay policies to sell products incurring in copyright infringement? Sure it is!
I can understand that eBay may sometimes overlook items that are not legal (there are so many zillions of items selling that I guess it must be an extremely hard task).
What I can't understand is that they allow some sellers to do it week after week, month after month and year after year.
Some time ago I was selling an original VARESE CD CLUB CD on eBay. On my item description I wrote something like "don't confuse the item I am selling with the shitty bootleg floating around".
Know what? My listing was removed because of the use of the word "shitty". Profanity they called it. Of course, they kept the listing fees. Well, simultaneously there were some wise guys selling the "shitty" bootleg I mentioned. Of course, nothing happened to them. Not a single listing was removed.
If eBay wants to encourage fair play on their listings then maybe they should start by cleaning off the crap polluting the system right now.
Yeah, I know, it's money that matters.....

Did you ever try to report those illegal bootleg sellers to eBay ?

well, this is an ironic world.
you shouldn't write those bad words in your description, that's all. nobody care about your attitude to bootlegs, not on ebay. you want sell something and not tell everybody your opinion about something.
shitty, but this is the real world.
in the first line ebay is scanning for such words like "shitty" & "bootlegs". I also had a similar experience, they deleted my auctions because I had such words in it like bootleg and promo.
I personaly don't care about those sellers with bootlegs, and I don't care about whether they make money with it. I bought some of such boots and I'm happy. Happy about the fact that I've got a score that is not going be released for years. Die waiting for something is shitty.
And ebay? lol this community is full of craps! but nobody care about this! this bootleg topic is and old thing and it's sensless to do something against it. I mean mafia is still existing, so.

People responding here are absolutely correct about two things:
1. There was NO reason to use profanity in your auction description, no matter how ticked off you were about the bootlegs listed on Ebay. I don't blam the Ebay staff for removing your listing.
2. Unauthorized items need to be REPORTED to the Ebay people...They have no way of knowing what is bootleg or not, and no one is stupid enough to use the word "bootleg" in their auction descriptions. Sellers DO use "roundabout" words and terms which...to those of us who know...are clearly words referencing bootleg items.
Do you have ANY idea how many Ebayers sell items like DVD-R movies and CD-R music discs? A LOT, I can assure you....but again, the Ebay people have no way of knowing if something is indeed unauthorized, nor do they know if the unauthorized copy of a movie or CD might be something which is in public domain (in other words, the copyright has expired).
AGAIN....If you're unhappy about Ebay's policies or procedures in matters like these...You need to REPORT the items to them.
THEN AGAIN....I've read many times on internet boards (at least in regards to movies on DVD-R) that collectors are quite satisfied with acquiring these titles if the company or studio in question who might own or hold rights to something has no intention of releasing it to that format. It's their loss, isn't it?

You're right Coma....One problem Ebay would have is that some companies, whether in regards to a CD or a DVD, DO use the -R format for their perfectly legitimate releases (companies such as Sinister Cinema ONLY releases their videos on DVD-R, and they're a perfectly legit, and legal company).
In the case of a recordable disc format....Ebay has no way of knowing a legit from an illegal release. One can't go by the disc format on that assumption.

hello to everybody collectors...
this is a very interesting problem!almost every day i reflect on buying or not this kind of titles!!!
anyway regarding this i'd like to know if THE BLUE THUNDER and all SUPERTRACKS cds are bootleg or something like that!
could be possible a day these title will receive a more "official release"?
Are they good products?sincerely i am interested on buying all their titles,but as you know they aren't cheap and so on....
An advise would be appreciated a lot....

Hi Ric. As far as I know, all of the SuperTracks CDs are official releases, not bootlegs. Go buy the Blue Thunder CD! It's a great soundtrack!

Bootlegs? Ebay? I think there are much more other auctions you have to take care about!
For example (on ebay):
4794197381 and auctions of re-animate or other dubios persons.
most of them coming from "USA" or eastern Europe(maybe the legislation is too easy)
P.S.: After nearly a year in search of I could make myself sure that the CDs of Blue thunder and Flight of the navigator are not bootlegs, but I could not assure if other releases are bootlegs or not. But don't doubt that this two releases are originals!
They are really collectible!!!

It's true . There are several european companies selling bootlegs as promos or "complete scores" like hurrican records and also some american labels! But sorry coma - the "BLUE THUNDER" score is not a bootleg.
You have to be better informed!!!
I 'm also not a friend of bootlegs - I hate bootlegs, but I wanna say that I would never exchange my 2 discs "The Bounty" soundtrack which were never released!
These are things which you may not keep back!!!!!
So if the attention will only be on the profit site this could anger persons(especially me).
But if there is really a background to content people, this should not be condemnable!!!

As far as Varese Sarabande goes, their ligit CD's are far more "Shitty" then most bootleg cds, lps, etc. They did a hack job to the Our Man Flint and In Like Flint scores, so those 2 scores have never been "officially" released as originally intended yet. They remix scores to remove sound effects and wash eveything in a bad dolby mix that is flatter then a wafer thin after dinner mint. Bootlegs are often highly prized collectors items worth WAY more than ANY CD that Varese Sarabande ever put out, and you can bet there would be a lot of unhappy people if you snitched on any of the sellers. Let it go. I mean, Russ Meyer even bootlegged himself by just putting out his soundtrack reels from 35MM onto CD and selling them as original soundtracks, all the while the real music is sitting in an archive in American Production Music vaults and do you think he wanted to pay the fee to Syd Dale to release the music in stereo without voice overs (which were nice anyway). No! By the way, Varese releases some of their soundtracks in the same manner without the customer knowing. BY ORIGINAL VINYL IF YOU HATE BOOTLEGS!!!

Hello.. I was wanting to contribute to this subject. I also seen the auctions on ebay and I am mad too. I did turn in someone that I bought a civil war cd from and nowhere in the auction did it say CD-R and then also, another one who just recorded a kenny chesney special from TV and I even asked him if it was a copy and he said yes. I DO have a DVD recorder and want to sell copies; but I don't think I am going to. I am just a little upset and the law that was in the previous post makes no sense. LOL but what does these days? It is NOT illegal to own bootlegs. The US Code does not prohibit the ownership of any live recording, even if it does infringe on the copyright-holder's rights.
It IS illegal to sell bootlegs. This law applies equally to all private individuals. Selling bootlegs for any profit what-so-ever, be it in the form of cash currency or bananas is illegal according to US Code 17, Section 1101. It used to be legal to sell bootlegs in Italy, but since the implementation of the European Union laws, this is now a thing of the past. Bootlegs were also legal in Australia for a period of time, although that time has long since past.
It is NOT illegal to purchase bootlegs. This is not mentioned anywhere in US Law. You can walk down to your local record store, and purchase a bootleg without having to worry about the cops breaking your door down.
The US Government WILL seize shipments of bootlegs intended for sale in the US. This is why bootleg companies tend to keep the packages they ship small. This is also the reason the cost of bootlegs is so high in the United States.

BOOTLEGS & BALLYHOO
As a former bootlegger, I can tell you that ebay IS cracking down on it. That's why I'm a
"former" bootlegger. While it appears on the surface that nothing is being done about it, I
have seen dozens of sellers (myself included) who have been suspended. One source that
ebay uses to determine if the listing is legal is allmusic.com. I specialized in lp's that
never went to cd, this website will tell you that. I found that out DIRECTLY from ebay. I
got tired of seeing bootlegs selling for extrememely high prices and sold them at a buy it
now price of $10. I have had my run of it and made plenty, but now that has come to an
end and there's no more ebay for me. If the record companies would get off their
collective asses and re release the OOP stuff, they could put an end to a great deal of the
bootlegging that does still go on.--ROCK ON..JB
