Phantom Ebay Sellers

Have you ever been stiffed by sellers on ebay? I recently bought Lord of the Rings on CD in that Special Edition orange case to complete my collection from a guy in France calling himself Filmmusicbatman, whose grasp of the English Language is somewhat suspect, who purports to have sent the CD on the1st Nov 2005. From our exchange of emails I am convinced he did not send me the CD and is now hiding behind the excuses giving me the brush off. Is there any other person who has been stiffed and is there any recourse to get compensated? I paid via paypal.

PS. Keep an eye out for this guy trying to re-sell that same CD.

Paypal will refund you if you asked for a registered mail without questions, because the seller cannot proof he shipped (this take about 15 days and must be filled before the 30 or 45 days of the date of payment).
If you didnt pay for a registered method, paypal will not be much helpfull, because they dont give much attention to regular shipments, but you can try anyway.
If the payment was with a credit card (I mean you didnt have money in the paypal account and they made the transfer from your card directly), then you can ask to the credit card for the refund, and you can say that he sold you pirate copys or didnt sent the mechandise.
Like I said before, its VERY IMPORTANT that you doit as fast as you can or you will not have time to get the money back.

BUT THE MOST IMPORTANT :
15 days is actually not an average time to receive mail (I mean if you live in USA)
The United States mail service, must be without question (in all this years I purchased in Europe, Asia, and America) the WORST and the SLOWEST mail service in the whole world and galaxy.
They are also totally non cooperative when you try to get a service or make a tracking from a insured or registered mail.

Hear this : they give you INSURED AIRMAIL, but cannot track the package.HOW THE F**K WILL THEY KNOW IF THE MAIL ARRIVE? THEY CANNOT KNOW, SO YOU JUST WAIT ONE MONTH AND ASK FOR THE INSURANCE MONEY.

I also had problems with REGISTERED airmail.They update the info AFTER you receive the mail, so why they give you the option to track it????????

If you made purchase with registered airmail from Italy (for example) it takes 10 days AT THE MOST, and I payed 9 euros for 8 CD!!!!!!!
The USPS charges you with more than $25 for this!!!! and takes 3 times more in arrive!

ive purchased a few items from this guy and have found him to be an exellent seller! im in the uk and have waited i think 10 days for the slowest item, but got here!! i think maybe your item got lost ?

I also have good experience with Filmmusicbatman (did just one transaction with him though), as well as I have on eBay in general. And FMB's feedback is excellent. You must have had a bad luck.

Hi! I have dealt with this seller in the past without any problems. This seller does ship their cd's, unlike some other sellers who do not. Your cd is probably in transit. Just be patient and give it a good 40 days, even though your cd should arrive way before. Remember to file your claim WITHIN 45 days (literally within 44 days 23 hours and 59 minutes. They do count every second!)after your date of payment (inclusive) to PayPal. Good luck!!

Thanks for the responses guys. I may get it then or I may not, it's just that this guy has a blase attitude to the emails we've exchanged that doesn't convince me. I mean if I had a negative feedback, I would chase up the postal service but as Nicolas28 has said, the postal service can be a pain in the ass. I know I have sent stuff to the US and it has taken weeks to get there. Well I've filed the claim, if the CD arrives then I will take it all back and let Paypal know. Thanks again guys.

I too purchsed from this guy. I got a copy of The Wild Geese on the Masters Film Music label. I found him to be a good seller, very prompt in sending me the CD.
